Coup of Constitution

13 Kasım 2023 Pazartesi

The Constitutional Court evaluated the application of Can Atalay, who was elected as an MP, and ruled on "violation of rights" and directed the case to the relevant court to release Atalay.

The relevant court did not make a decision and left the matter to the Court of Cassation.

The Court of Cassation, on the other hand, did not recognize the Constitutional Court's decision and filed a criminal complaint against the members of the Constitutional Court.

Thus, a "constitutional crisis" was born.

Not taking the Constitution seriously and not implementing its articles is not only a "judicial crisis", but it is also a full-on "state crisis".

The new CHP leader Ozgur Ozel drew attention to this dangerous situation and called on the parliament, lawyers, institutions and citizens to "resist against the constitutional coup".

The Union of Bar Associations organized a "constitutional march" to the Supreme Court of Appeals together with the heads of bar associations.

WHAT NOW?

The general opinion is that "the Supreme Court of Cassation would not attempt to take such a drastic step without the knowledge and support of the presidential palace".

Indeed, President Erdogan supported the Supreme Court on the issue and declared that the Constitutional Court had made wrong decisions and that the issue could only be resolved with a new constitution.

Thus, the options in the situation that could emerge from now on are as follows:

One: The Constitutional Court's decision will be implemented, Can Atalay will be released and the judicial crisis will be frozen.

Two: The crisis in the high judiciary will continue, the resistance against the constitutional coup will continue, and the situation will turn into either a political compromise or conflict.

Three: Common sense will prevail, the Presidential Palace will stop insisting on this issue and the constitutional order will be maintained.

The chaos created by the "judicial crisis" will lead to negative consequences on all sides.

ILLEGALIZATION leads society to the path of "vindication of rights - taking one's rights" and in this dangerous situation, nothing can be safe for anyone anymore.

Such a situation would lead the nation to ways of "anarchy", which is not a desirable situation of any kind.

CALL FOR COMMON SENSE

We are making a "call for common sense" to all authorities, especially the Presidential Palace and President Erdogan.

No one can predict the consequences of this situation if the country plunges into chaos, just because one wants to make "the absolute judgment"

As an experienced politician, Erdogan can see that if he acts with common sense by resisting the provocations of those who are around him, the situation could turn out to be devastating.

This means that President Erdogan, who derives his current authority from the existing constitution, should take a stance that protects the "constitutional order".

If they are not satisfied with this, they can try to achieve this through legal means.

But ignoring the "constitutional order" will bring nothing but chaos to both the Presidential Palace and society.

Social resistance will bring this common sense to those who govern the country.

A society can only prove its existence through its own dynamism.

In this sense, we can say that Ozgur Ozel, the new chair of the Republican People's Party, is on the right track.

Ozgur Ozel expresses that if a community wants something, they must earn it first.

Do you want "constitutional order"? Prove it.

Do you want "independent law"? Stand up for it.

Common sense is not equal to surrender.

Common sense is fighting for the goals you desire

COMMEMORATING ATATURK

The fact that these events took place right on the days of "Commemoration and Celebration of Ataturk" should draw our attention.

"Missing Ataturk" cannot be enough.

"Commemorating Ataturk" should not be enough.

"Living and keeping Ataturk alive" is our duty for today.

Ataturk is a revolutionary. He is a man of action.

Ataturk is the founder of the future.

Ataturk established civilization, the future of the nation.

Let us not forget his words:

"The truest guide is knowledge and science."

"Independence is my character".

"How happy is the one who says I am a Turk!".

"Sovereignty unconditionally belongs to the nation".

WHO IS ENTITLED TO SOVEREIGNTY

"Sovereignty unconditionally belongs to the nation"

Ataturk said these words to the Ottoman palace and the caliph-sultan sitting there.

Are we experiencing a "conflict of sovereignty" again today?

Is the Presidential Palace's "one man to rule" ideal being imposed again?

Is the constitutional crisis being created for this purpose?

Whatever the reason, we defend the constitutional Republic and democracy.

"Sovereignty unconditionally belongs to the nation"

Ataturk will always be our leader.

Until the end of time...
